These conditions are concluded between the Company Grano Loco, SAS registered 918 382 904 RCS Annecy, with a share capital of 5000 euros and whose registered office is located at 23 rue de lachat, 74940 Annecy le Vieux, hereinafter referred to as "Grano Loco" , and any natural or legal person making a purchase on the Granoloco site, hereinafter referred to as "the customer", and collectively referred to as "the Parties".

The customer declares to be of legal age or holder of parental authorization and to have the legal capacity to contract allowing him to place an order on this website.

At the time of his order, the customer acknowledges having read the general conditions of sale and accepting them without reservation by checking the box “I have read the general conditions of sale”.

The Parties agree that their relations are governed exclusively by these general conditions of sale. These terms may be subject to change. Therefore, it is understood that the applicable conditions are those in force on the site at the time of placing the order on the site.

  1. Product :

Grano Loco offers coffee on its site but also the equipment necessary for the preparation of a coffee as well as delicacies and accessories. Each product is accompanied by a description drawn up by Grano Loco. The photographs in the catalog are as accurate as possible.

  1. Price :

The prices of the products on the site are prices including VAT in euros taking into account the VAT applicable on the day of the order. Grano Loco reserves the right to modify its prices at any time, it being understood that the price appearing on the site on the day of the order will be the only one applicable to the Customer.

The prices of the products displayed on the site do not include postage, the price of certain packaging or the price of other optional services, subscribed to by the customer, which remain extra.

These will be brought to the attention of the customer on the summary screen before final validation of the order.

  1. Order :

Placing an order is done in several steps, the customer must:

– choose your products and add them to your basket

– validate the contents of his basket

– login or create an account

– choose your delivery method

– choose your method of payment

– accept the T&Cs

– make and validate payment.

The customer will then receive an e-mail confirming his order by Grano Loco.

The order validation e-mail signifies the acceptance by Grano Loco of the customer's order and thus forms the sales contract between the Parties. The invoice is attached to the payment validation.

As soon as the order leaves for shipment, Grano Loco will send an order dispatch email to the customer.

  1. Payment :

All orders are payable in euros at the time of the order.

Payment for purchases is made by means of a bank payment card from the following cards:

Grano Loco guarantees the security of payment data by using payment platforms and an authentication payment system to enhance security during your online purchases. At the time of payment, your bank verifies the identity of the cardholder before validating the transaction.

  1. Delivery :

Our products can be delivered to all the countries indicated on our site, the exact list depending on the delivery method chosen when ordering.

The possible delivery methods are:

To metropolitan France and the European Union (excluding specific territories: Canary Islands, Balearic Islands, Ceuta, Melilla, Azores, Madeira). The delivery time depends on the chosen delivery method. The delivery times announced on the site are from the date of leaving the workshop of the products ordered by the customer, these times may not exceed 30 days from the validation of the order on the site. Shipments are made Monday through Friday only.

As part of a delivery by La Poste, the customer absent at the time of delivery has a period of 10 working days to collect his package at the post office indicated. Beyond this period, the package will be returned to Grano Loco. The site will then make a first reminder to the customer, in the absence of a response from the customer within 7 days Grano Loco will consider that the customer has exercised his right of withdrawal.

Grano Loco also offers on-site collection at 524 route d'Albertville, 74320 Sevrier, 2 days after the order.

The customer is required to check the good condition of the products delivered. Any anomaly noted must be indicated by email to info@grano-loco.com within 3 days of receipt.

  1. Withdrawal:

Equipment and Small Material:

In accordance with the legal provisions in force, the customer has a withdrawal period of 14 days from the day of receipt of the order to notify Grano Loco (by e-mail to the address info@grano-loco.com ) his wish to return his order to us, then 14 days from this notification to send it back to us. For health and safety reasons, only unused products will be taken back, properly protected, in their original packaging intact, in perfect condition, suitable for resale, accompanied by all possible accessories, instructions for use and documentation as well as than the corresponding invoice. These conditions are cumulative. Subject to the above, Grano Loco will issue a credit note corresponding to the price of the returned products and the shipping costs invoiced (based on the standard delivery costs), if they have already been paid, and this within 14 days. following the date on which the right of return was exercised. Return shipping costs will be borne by the customer. The customer must return the products to the following address: Grano Loco, 524 route d'Albertville 74320 Sevrier.

Coffee :

In accordance with article L.121-20-2 of the Consumer Code, the withdrawal period is not applicable for the purchase of perishable goods.

  1. Availablity :

Our products are available at the prices indicated as long as they are visible on the site, except for special operations for which the period of validity and/or the quantity available is specified on the site. The customer is invited to consult the availability of the items sold on the detailed sheet of each product.

In the event of an order for an item that turns out to be unavailable, Grano Loco reserves the right to cancel the order, subject to notifying the customer.

In the event of an order for several products, if one of the products ultimately turns out to be unavailable, Grano Loco will then inform the customer of the impossibility of sending the unavailable product. The rest of the order will be processed and shipped to the customer within the deadlines announced on the site.

  1. Responsibility :

Grano Loco cannot be held liable for any consequential damages that may arise from the purchase of the Products. Similarly, Grano Loco's liability under the obligations of the GCS cannot be engaged in the event of the occurrence of an event of force majeure as defined by the French courts.

Interview

Routine maintenance of the machine and its cleaning are the customer's responsibility. Given the technical specificities of the machines and for safety reasons, repairs must only be carried out by the manufacturer's after-sales service according to the conditions specific to each machine. Consequently, the manufacturer and Grano Loco will be released from all liability in the event of modification, repair, addition and/or replacement of spare parts on the machine by any party other than the after-sales service.

Guarantee

The machines are guaranteed by the manufacturer according to the conditions transmitted at the time of purchase, without prejudice however to the legal guarantee against hidden defects as provided for by articles 1641 to 1649 of the Civil Code providing in particular that "The seller is bound by the guarantee on account of hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lower price for it , if he had known them" and the legal guarantee of conformity provided for by articles L. 211-4, L. 211-5 and L. 211-12 of the consumer code providing in particular that "The seller is required to deliver a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. The prior search for an amicable solution does not interrupt the deadlines for acting as a guarantee.

In the absence of an amicable agreement, the competent Court will be, at the choice of the plaintiff and in accordance with the legal provisions, either that of the place where the defendant lives, or that of the place of actual delivery of the Product(s), or that of the place of delivery. performance of the service.

As part of a professional-to-professional sales contract, the Parties expressly agree to submit this contract to French law.

The Parties expressly agree that the Vienna Convention on the International Sale of Goods cannot be applied in their relationship. To this end, any dispute that has not found an amicable solution will be subject to the exclusive jurisdiction of the competent courts of Versailles, notwithstanding multiple defendants and/or warranty claims, even for emergency procedures or interim interim procedures. or by request.
